Surgery

 

A monthly surgery is conducted at the Hollies on the 1st Thursday of every month in Midsomer Norton for anyone experiencing racially motivated discrimination or harassment.

Time: 4-5 PM

LEGAL CONSEQUENCES

Harassment and Discrimination at Work

  • Covers a wide range of oppressive and unwelcome behaviour
  • Following are recognised by tribunals: jokes, banter, name calling, unwelcome gifts, display of publications, leering and sexual assault.
  • Direct discrimination: - less favourable treatment "race, sex or disability"
  • Sexual orientation / religion and belief / age
  • Freestanding right to be protected from "Harassment" - Compensation is unlimited.
  • Vicarious liability

What can you/the employer do?

  • Organisations should make clear that bullying and harassment is unacceptable.
  • Set example - senior management
  • Procedures for complaint - grievance and disciplinary
  • Investigate complaints fairly and properly and take them seriously
  • Counselling service /helpline
  • Training

When Discrimination Can Happen

Discrimination happens when someone is treated worse ('less favourably' in legal terms) than another person in another situation. This deals with your rights if you are discriminated against because of your:

  • race
  • colour
  • nationality
  • national or ethnic origin.

We use the words 'race' and 'racial' to cover all of these things. People may suffer discrimination in a number of situations. It can happen:

  • when buying or using goods and services
  • at work
  • when trying to buy or rent somewhere to live
  • at a school or college
  • when dealing with authorities (e.g. the police)

There are other related equalities areas:

  • 'Equal Opportunities' looks in more detail at the laws on discrimination because of your sex and also your rights if you are discriminated against because of your age or your religious beliefs.
  • 'Rights for People with Disabilities' which looks at dealing with discrimination if you have a disability.

You may find that you are discriminated against for more than one reason. If this is the case, you may need to get advice about the best course of action. You can get advice from:

  • a trade union
  • your local Law Centre
  • a Citizens Advice Bureau
  • a solicitor

Racial discrimination is not the same as racial abuse (being attacked for example). Racial abuse is a crime, and if you have been a victim, you should report it to the police

What the Law Says

The Race Relations Act 1976 protects you against racial discrimination and harassment. It also gives you the right to challenge unfair treatment in courts or at an employment tribunal.

The Race Relations (Amendment) Act 2002 extends the original act. It makes racial discrimination by organisations that enforce the law, such as the police, unlawful. This law also says that government departments and other public organisations must have policies to promote racial equality

Direct and Indirect Discrimination

  • Direct discrimination is when you are treated less favourably because of your race.
  • Indirect discrimination is where there are rules or conditions which apply to everyone, but which affect one group of people more than others, where there is no good reason for the rule. For example, a company rule that employees must not wear headgear could exclude Sikh men who wear a turban.

Victimisation

If you want to complain about being discriminated against (or if you are helping a colleague who is complaining), you may fear that your employer may, for example, treat you less favourably for this reason. If they do, this is called victimisation, and is unlawful in the way discrimination is.
